1. Acceptance of Terms

By accessing or using our services, website, or engaging in a project with Industry Grade Websites (“IGW”, “we”, “us”, or “our”), you agree to these Terms of Service (“Terms”) and any future modifications. If you do not agree to these Terms, you may not use our services.

2. Services Overview

IGW provides web design, development, and related consulting services. Our projects are guided by a process that includes: discovery, architecture planning, wireframing, copywriting, visual design, development, testing, and launch. Post-launch services (marketing, hosting, SEO) may be offered separately.

3. Client Responsibilities

To ensure timely delivery and quality results, clients agree to:

Provide accurate and timely access to all required assets (logos, brand guidelines, images, credentials, etc.)Participate in approvals and feedback loops within the agreed timelineClearly communicate project goals and required outcomes

Any delay in these responsibilities may result in adjusted project timelines or additional fees.

4. Payment Terms

Unless otherwise agreed in writing:

Projects are billed in two installments: 50% deposit upfront, 50% upon completionHosting fees are billed annually and are non-refundable once the hosting period beginsAdditional features or scope changes outside the agreed project may require a separate quote

We offer a 100% money-back guarantee on our web design projects if the final product fails to meet the agreed deliverables and we are unable to resolve the issue after a good-faith attempt.

5. Intellectual Property

Clients retain full ownership of all website content, copy, and branding provided by themUpon full payment, clients own the rights to the final website, including all original code and design assets created specifically for themIGW reserves the right to showcase completed work in our portfolio unless the client requests otherwise in writing

6. Hosting & Post-Launch

Clients using our optional hosting service agree to annual billing with no long-term contract. Hosting is managed by IGW and includes performance monitoring, basic security, and uptime support. Clients are free to move hosting elsewhere at any time, and we will assist with the transition if needed.

7. Project Timeline & Scope

Our typical project duration is 14–18 days. Timelines may shift based on client response time or requested scope changes. If a project is delayed more than 30 days due to client inaction, IGW reserves the right to pause or terminate the project and may require a reactivation fee.

8. Third-Party Tools & Integrations

Any third-party plugins, themes, or services used in your project (e.g., CRM tools, booking software, SEO platforms) are subject to their own licensing terms and costs, and IGW is not responsible for their performance or uptime.

9. Limitation of Liability

IGW is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use your website or related services. In no event will our total liability exceed the amount paid by you for the services rendered.

10. Termination

Either party may terminate a project at any time by providing written notice. If terminated mid-project, work completed to date will be billed proportionally and the balance refunded or invoiced accordingly.

11. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Updated terms will be posted to our website with an effective date.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes shall be handled in the appropriate courts of Ontario.
